These Terms of Use (“Terms”) govern access to and use of Costa’s public websites, including costa.app, docs.costa.app, trust.costa.app, and status.costa.security, together with the content, documentation, and materials made available on them (collectively, the “Sites”). The Sites are operated by Costa Security Inc. (“Costa”, “we”, “us”).

These Terms do not govern the Costa Platform. Access to and use of the Costa Platform (including ai.costa.app, the Costa Gateway, APIs, dashboard, CLI, and TUI) is governed by the Costa Cloud Service Agreement at costa.app/legal/cloud-service-agreement (the “CSA”). The Costa CLI software is licensed under the Costa CLI License included with the software. If these Terms conflict with the CSA with respect to the Costa Platform, the CSA controls.


1. Acceptance

By accessing or using the Sites, you agree to these Terms, our Privacy Policy at costa.app/legal/privacy, and our Cookie Policy at costa.app/legal/cookie-policy. If you do not agree, do not use the Sites. If you use the Sites on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

2. Eligibility

The Sites are intended for business and professional use. The Sites are not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Sites.

3. Changes to These Terms

We may update these Terms from time to time. The version and effective date above reflect the current version, and the changelog below summarizes changes. Material changes will be posted on the Sites. Continued use of the Sites after changes take effect constitutes acceptance of the revised Terms.

4. Intellectual Property; Limited License

The Sites and all content on them (including text, documentation, graphics, logos, page designs, videos, and software) are owned by Costa or its licensors and are protected by intellectual property laws. “Costa”, the Costa logo, “Tool Defender”, “Cosmic Routing”, and “Trim” are trademarks of Costa Security Inc.

Costa grants you a limited, revocable, non-exclusive, non-transferable license to access and view the Sites and their content for your internal business purposes, including evaluating Costa’s products. Code samples in the documentation may be used to build integrations with the Costa Platform under the CSA. No other rights are granted. Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit Sites content without Costa’s prior written consent.

5. Acceptable Use of the Sites

You may not:

(a) probe, scan, or test the vulnerability of the Sites, or breach or circumvent any security or authentication measure, except through coordinated disclosure arranged in advance with security@costa.app;

(b) access the Sites through automated means (including scrapers, crawlers, and bots) other than standard public search engine indexing consistent with our robots.txt;

(c) use Sites content, in whole or in part, to develop, train, fine-tune, or improve any AI or machine learning model;

(d) interfere with or disrupt the Sites or the servers and networks connected to them, or impose an unreasonable load on our infrastructure;

(e) misrepresent your affiliation with any person or entity, or state or imply that Costa endorses you or your products without our written consent;

(f) frame or mirror any part of the Sites without our written consent; or

(g) use the Sites in violation of applicable law or, where it applies to you, the Costa Acceptable Use Policy at costa.app/legal/aup.

6. Documentation and Informational Content

Documentation, guides, pricing summaries, status information, and other content on the Sites are provided for general information. They may change without notice, may not reflect the current state of the Costa Platform, and do not form part of any contract unless expressly incorporated into the CSA or an Order Form. Nothing on the Sites constitutes legal, financial, security, or compliance advice.

7. Feedback

If you submit feedback, suggestions, or ideas about the Sites or Costa’s products, you grant Costa a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, without restriction or obligation to you.

8. Third-Party Sites and Services

The Sites link to third-party websites and reference third-party services, including AI model providers and their usage policies. Costa does not control and is not responsible for third-party sites, services, or content. Your use of them is at your own risk and subject to their own terms.

If you believe content on the Sites infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to legal@costa.app or to Costa Security Inc., 3790 El Camino Real #1090, Palo Alto, CA 94306, Attn: Legal.

10. Disclaimers

THE SITES AND ALL CONTENT ON THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. COSTA DOES NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ANY WARRANTIES FOR THE COSTA PLATFORM ARE STATED EXCLUSIVELY IN THE CSA.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) COSTA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITES; AND (B) COSTA’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). LIABILITY RELATING TO THE COSTA PLATFORM IS GOVERNED EXCLUSIVELY BY THE CSA. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You will defend and indemnify Costa against third-party claims, and resulting damages and reasonable costs, arising from your misuse of the Sites or your violation of these Terms.

13. Suspension and Termination

Costa may suspend or terminate your access to the Sites at any time, with or without notice, including for violation of these Terms. Section 4 (ownership provisions) and Sections 7 through 15 survive any termination.

14. Governing Law; Venue

These Terms are governed by the law, and disputes are subject to the exclusive venue, specified for your location below, excluding conflict of laws rules, and each party consents to personal jurisdiction there:

15. General

These Terms are the entire agreement between you and Costa regarding use of the Sites and supersede prior agreements on that subject. They do not modify the CSA, the Data Processing Addendum, the Acceptable Use Policy, the Privacy Policy, or any Order Form. If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Costa’s failure to enforce a provision is not a waiver of it. You may not assign these Terms without Costa’s consent; Costa may assign them in connection with a merger, acquisition, corporate reorganization, or sale of assets.
